Article 1
Les conditions générales sont applicables aux devis, offres, bons de commande et factures émises par Serendipities SPRL.
Article 2Les factures doivent être payées dans les 10 jours suivant la date de facture. A défaut d’être payée à l’échéance, toute facture impayée sera majorée de plein droit d’une clause pénale égale à 10 % avec un minimum de 100 EUR augmenté d’un intérêt tel que prévu par la loi du 02.08.2002 sur les retards de paiement dans les transactions commerciales.
Serendipities SPRL se réserve le droit de confier à un tiers le recouvrement à l'amiable et judiciaire de ses créances. Les coûts d'assignation, les dépens et autres coûts que devra supporter Serendipities SPRL afin de récupérer par voie judiciaire les montants qui lui sont imputés sont également à charge du client. 
Article 3Toute réclamation relative à une facture devra être transmise par écrit, au siège social de Serendipities SPRL, huit (8) jours ouvrables maximum après sa réception. À défaut, le Client ne pourra plus contester cette facture. 
Article 4Les présentes conditions générales sont régies par le droit belge et tout éventuel litige sera de la compétence exclusive des tribunaux de Nivelles.
Article 6
Tout travail supplémentaire ou exécuté en urgence sera planifié en fonction des contraintes de Serendipities SPRL et facturé en sus.

Article 7
Les délais de livraison ne sont donnés qu’à titre indicatif et ne constituent pas un engagement ferme de la part de Serendipities SPRL. Serendipities SPRL se réserve le droit d’organiser les plannings en fonction de ses disponibilités et contraintes. Aucun délai de livraison ou d’exécution n’est garanti sauf mention spécifique dans le contrat. Sauf stipulation contraire convenue entre les parties par écrit, un retard dans la livraison ou l’exécution ne peut pas donner lieu à une indemnité quelconque ni à l’annulation de la commande de la part du Client. 
Les délais ne commencent à courir qu’à partir du moment où toutes les informations nécessaires à la bonne exécution de ses prestations sont en possession Serendipities SPRL. Le Client s’engage à fournir toutes les informations nécessaires. Tout retard de fourniture d’informations par le Client tout au long du projet aura une répercussion sur le délai final.

Article 10
Serendipities SPRL a une obligation de moyens. 

Article 13 
Serendipities SPRL ne pourra être tenue pour responsable de tout préjudice financier ou commercial subi par le Client tels que le manque à gagner, augmentation de frais généraux, perturbation de planning, perte de profit, de clientèle ou d’économie escomptée, etc. 

Serendipities SPRL sera déliée de toute responsabilité si elle n’a pu remplir ses obligations pour des motifs indépendants de sa volonté, notamment: faits de tiers, causes de force majeure, erreur d’un fournisseur,... 
Quelle que soit la gravité de sa faute, hormis la faute lourde et le dol, la responsabilité de Serendipities SPRL est limitée à la réparation des dommages directs réellement subis et dûment établis, jusqu’à concurrence de 20 % de la valeur des prestations ou produits livrés dans le cadre de la commande, pour tout dommage quel qu’il soit.

Article 15
Les documents (brochures, rapports, présentations, sites web, mailings, communiqués de presse,..) créés par Serendipities SPRL sont protégés par la législation concernant le droit d’auteur et par la législation relative à la propriété intellectuelle. Ces droits appartiennent à Serendipities SPRL, sauf mention contraire dans l’offre et/ou la facture.

Article 18 
Serendipities SPRL se réserve la possibilité d’inclure dans les produits ou services à fournir, une mention commerciale indiquant clairement sa contribution. Serendipities se réserve le droit de mentionner ses réalisations comme référence dans le cadre de ses démarches de prospection commerciale, de communication externe et de publicité.

Retention time
Personal Data shall be processed and stored for as long as required by the purpose they have been collected for.
Therefore:
Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.
The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn.
